1. Overview and Legal Basis
Ergora LLC complies with all applicable email marketing laws, including the CAN-SPAM Act of 2003 (15 U.S.C. § 7701-7713). This Policy explains how we handle email communications, distinguish between different types of emails, manage opt-outs, and respect user preferences.
The CAN-SPAM Act imposes requirements on certain types of commercial emails but provides exemptions for transactional emails (emails necessary to the business relationship). This Policy clarifies which emails fall into which category and explains how users can control their email preferences.
2. Transactional Emails (CAN-SPAM Exempt)
2.1 Definition
Transactional emails are messages necessary to facilitate the business relationship between Ergora and the user. These emails are exempt from the opt-out requirements of the CAN-SPAM Act because they provide essential account and service information.
2.2 Examples
- Account Confirmation: Verification links to activate your account
- Password Reset: Password reset links when you initiate account recovery
- Subscription Receipts: Confirmation after a subscription payment is processed
- Security Alerts: Notifications of suspicious login attempts, password changes, or other security events
- Data Export Confirmations: Status updates for data export requests
- Billing Updates: Upcoming renewals, failed payments, or billing changes
- Service Status Alerts: Platform outages, maintenance, or service interruptions
2.3 No Unsubscribe Required
Transactional emails do not require an unsubscribe link because users cannot legitimately opt out of account-critical communications. You will continue to receive transactional emails as long as you have an active account, even if you have unsubscribed from marketing communications.
3. Marketing and Commercial Emails (CAN-SPAM Compliant)
3.1 Definition
Marketing and commercial emails are messages intended to encourage the purchase of products or services, promote the platform, or communicate company news. These emails are subject to CAN-SPAM requirements.
3.2 Examples
- Product feature announcements and release notes
- Blog content and educational articles
- Promotional offers and limited-time discounts
- Webinar and event invitations
- Product newsletters and best practices
- Company news and partnership announcements
3.3 Opt-In Requirement
Marketing emails are sent only to users who have explicitly opted in to receive marketing communications. At account signup, users are presented with a clear opt-in checkbox. Users who do not opt in will receive transactional emails only. You may change your preferences at any time in account settings.
3.4 Unsubscribe Requirement
Every marketing email includes a clear, one-click unsubscribe link that is clearly visible, uses plain language, is functional without requiring login, and is processed automatically with no manual delay.
3.5 Unsubscribe Processing
Unsubscribe requests are processed within ten (10) business days. Once processed, you will not receive further marketing emails but will continue to receive transactional emails.
4. Waitlist and Pre-Launch Emails
Before full public launch, Ergora maintains a waitlist. Emails to waitlist subscribers are sent solely for launch notification. Waitlist subscribers are not automatically enrolled in marketing email programs. Once they create an account, standard opt-in preferences apply. Each waitlist email includes an unsubscribe option.
5. Email Forwarding Feature
The platform includes an optional email forwarding feature allowing users to forward appraisal orders from AMCs to an ergora.ai forwarding address. This is a Service function, not marketing, and is not subject to CAN-SPAM opt-out requirements. Users can enable or disable forwarding at any time in account settings.
6. Referral Program Communications
Referral invitations are sent by individual members, not by Ergora on behalf of members. Each member is responsible for complying with CAN-SPAM requirements for their own referral communications, including obtaining prior consent, using accurate header information, providing a physical postal address, and honoring unsubscribe requests. The Acceptable Use Policy and Referral Program Terms prohibit spam and misleading marketing.
7. Required Information in All Commercial Emails
Every marketing email from Ergora includes:
- Clear sender identification (Ergora LLC)
- Accurate, non-misleading subject line
- Physical postal address (Ergora LLC, 13750 Embers Ct, Plymouth, MI 48170)
- Functioning one-click unsubscribe link
- Unsubscribe requests honored within 10 business days
- Clear identification as advertisement when applicable
8. Email Preference Management
8.1 User Preference Center
You can manage email preferences in your account settings: enable/disable marketing emails, select types to receive, change your email address, and set frequency preferences.
8.2 Unsubscribe Links
You can also unsubscribe directly from any marketing email. No account login is required. Processed automatically within 10 business days.
8.3 Preference Changes
Changes take effect within twenty-four (24) hours.
9. Data Portability and Communication History
You may request an export of your email preferences and communication history by emailing privacy@ergora.ai. Requests are processed within 30 days in CSV or JSON format.
10. Compliance and Remediation
Ergora actively monitors its email programs for CAN-SPAM compliance. Email lists are regularly audited and unsubscribe requests verified. If you believe you have received non-compliant emails, report the issue to privacy@ergora.ai with the full email text, sender information, and date received.
